Terms of Use
1. Acceptance of terms
By creating an account, accessing or using TRADEKAP (the "Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. These terms constitute a binding contract between you and TRADEKAP.
2. Description of the Service
TRADEKAP is a software tool for trade journaling and order execution on MetaTrader platforms (MT4 and MT5). The Service includes an automatic journal, an execution terminal, multi-account management, statistics and an AI coach. TRADEKAP is a tool only: it does not provide investment advice, recommendations, portfolio management, or signal-copying services. You retain full control of every trading decision.
3. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into binding contracts. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information at registration and to keep it updated.
4. User responsibilities
You are solely responsible for your trades, your compliance with your broker's rules, and the rules of any prop firm whose account you connect. You must verify that your prop firm permits automated trade management (EAs) before installing any program. TRADEKAP does not verify and is not responsible for the rules of your broker or prop firm.
5. Subscriptions and billing
Subscriptions are billed in advance per period (monthly, quarterly or yearly). Prices are displayed in USD and converted to your display currency for convenience. You may add extra accounts and add-ons at any time. Payments are processed by our payment provider (Paddle). You authorise recurring charges until you cancel.
6. Cancellation and refunds
You can cancel your subscription at any time from your account. Cancellation takes effect at the end of the current paid period. You keep full access until then. Refund requests are handled case by case. Contact us at the support address shown on this site.
7. Trial period
A free trial may be offered, during which no charge is made provided you cancel before the trial ends. If you do not cancel, your card is charged at the end of the trial for the next billing period. The trial duration is shown at sign-up.
8. Intellectual property
TRADEKAP, its software, its MetaTrader programs (EAs), its design, its content and its trademarks are the property of TRADEKAP or its licensors. You receive a personal, non-exclusive, non-transferable licence to use the Service for the duration of your subscription. You may not copy, redistribute, reverse-engineer or resell the Service.
9. Data and privacy
Your trading data belongs to you. Each client is isolated in their own workspace. Your broker credentials never transit through TRADEKAP. See our Privacy Policy for details on data collection, use and your rights.
10. Limitation of liability
Trading on margin carries a high risk of capital loss. You can lose more than your initial deposit. TRADEKAP, its operators and its suppliers are not liable for any trading losses, missed opportunities, technical failures, or indirect or consequential damages. The Service is provided "as is" without any warranty, express or implied.
11. Disclaimers
TRADEKAP provides no investment advice, no recommendation, and no portfolio management. Nothing on the Service constitutes a solicitation, offer or recommendation to buy or sell any financial instrument. You alone decide on your trades. Past performance does not predict future results.
12. Indemnification
You agree to indemnify and hold harmless TRADEKAP, its operators and its suppliers from any claim, loss or damage arising from your use of the Service, your violation of these terms, or your violation of any law or third-party rights.
13. Termination
We may suspend or terminate your access if you breach these terms, if your account remains unpaid, or if required to comply with legal obligations. Upon termination, your data is retained but access is revoked. No refund is owed beyond the end of the paid period.
14. Changes to terms
We may update these terms at any time. Material changes will be notified by email or on the Service. Continued use after the effective date constitutes acceptance of the updated terms.
15. Governing law
These terms are governed by the laws applicable at the registered office of TRADEKAP. Any dispute shall be submitted to the exclusive jurisdiction of the courts of that jurisdiction, unless mandatory consumer law provides otherwise.
